2. Definitions

• Traveler: A user who offers to deliver parcels for senders while traveling.
• Sender: A user who requests delivery of parcels via Travelers.
• Receiver: A user who receives the parcel from the Traveler.
• Platform: Cholofly.com, the service provider facilitating transactions between Travelers, Senders, and Receivers.

3. Eligibility

You must be at least 18 years old to use our platform. By using our services, you represent and warrant that you are of legal age and have the capacity to enter into a binding agreement.

4. User Registration

To use our platform, you must register and create an account. You agree to provide accurate and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Identification

Both the Sender and the Traveler must agree to present proper identification to the platform authority at the time of parcel pick-up and delivery. Failure to do so may result in the cancellation of the transaction and potential legal action.

6. Services

Cholofly.com provides a platform for Travelers and Senders to connect and facilitate the delivery of parcels. We do not directly handle parcels or provide delivery services. Our role is limited to facilitating transactions and communication between users.

7. Parcel Details and Declarations

The Sender must provide accurate and complete details about the parcel, including its contents, weight, and dimensions. False declarations or misleading information may result in legal action, including but not limited to fines and penalties. The Traveler has the right to inspect the parcel before accepting it for delivery.

8. Delivery Times

Delivery times may vary due to customs processing, location, and other unforeseen circumstances. We do not guarantee specific delivery times and are not responsible for delays beyond our control.

9. Fees and Payments

Users agree to pay the applicable fees for the services provided. Payment terms will be specified at the time of transaction. All payments must be made through the platform's designated payment system. We reserve the right to change our fees at any time.

10. Refund Policy

In the event that a parcel is not delivered, the Sender may be eligible for a refund of the service fee, excluding any non-refundable charges such as customs fees and taxes. Refund requests must be submitted within 30 days of the scheduled delivery date. Refunds will be processed within 14 business days upon approval.

11. Damage Claims

We do not accept any liability for damage to parcels during transit. Travelers and Senders are encouraged to arrange for appropriate insurance coverage for valuable or fragile items.

12. User Conduct

Users agree to use the platform in a lawful and respectful manner. Prohibited activities include, but are not limited to:

• Providing false or misleading information.
• Engaging in fraudulent or deceptive practices.
• Harassing or abusing other users.
• Violating any applicable laws or regulations.

13. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the platform will cease immediately.

14. Limitation of Liability

To the fullest extent permitted by law, Cholofly.com and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the platform.
• Any conduct or content of any third party on the platform.
• Any content obtained from the platform.
• Unauthorized access, use, or alteration of your transmissions or content.

15. Indemnification

You agree to indemnify and hold harmless Cholofly.com and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the platform.
• Your violation of these Terms.
• Your violation of any third-party right, including without limitation any intellectual property right or privacy right.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
